this may be a dumb question but when you step on the brake can you see the brake light or are these just for show only? are they legal or not?

ive tinted a lot of tail lights and ive never heard of anyone having problems with them. I tinted my own tails, been pulled over plenty, never had a complaint from a cop. no third brake light either.
